The Energy Performance of Buildings- enforcement update

From 3rd December 2009 the enforcement of Energy Performance Certificates became the responsibilty of district councils via building control departments. If an EPC and the associated recommendation report are not provided by the landlord,owner or builder of the property you can contact the relevant council and enforcement authority regarding this issue.

 

Penalties can range as shown:

Existing Dwellings/New Dwellings - £200 per offence

Non - Dwellings - calculated as 12.5% of net annual value of each heriditament per offence ,from a minimum of £500 to a maximum of £5000.

Public Buildings - Display Energy Certificates - non display of valid DEC £500 per offence , non possession of a valid advisory report £1000 per offence.

Documents - failure to produce for inspection ( within 7 days ) after a request from an authorised officer of an enforcement authority for copies of

a valid EPC and recommendation report

a valid advisory report or

the most recent inspection report

£200 per offence
